Scope in Canada and outside Canada
These Terms govern official Kawaii Pizza™ services: the website, orders, physical and digital products, applications, software, video games —including Kawaii Pizza™: Cats vs Customers— and their content and updates. Their purpose includes protecting the brand, its assets, the security of its services and the rights of owners and licensors.
They address users in every Canadian province and territory and in other countries, to the extent services are available and these Terms validly apply. International access is not an offer of worldwide food delivery, app distribution or sales. Availability and service areas are specified in each offer.
Kawaii Pizza™ identifies the brand used for these services and is not, by itself, a legal person. Before a sale or licence is concluded, the offer identifies the contracting supplier, its legal name, address and contact details, and its capacity as owner or authorized licensee where relevant. Rights in each asset belong to their respective owners or licensors. Any other supplier involved in an offer is identified, with its role, before the contract is concluded.
Intellectual-property rights are reserved wherever those rights exist, including against unauthorized uses by persons who have not accepted a contract. Contractual obligations require valid acceptance. Nothing in these Terms excludes mandatory rules applicable to the contract, consumers, privacy or the territory of protection.
Acceptance, capacity and evidence of agreement
Before accepting an order, licence or additional terms, users must be able to consult, retain and review the applicable version. Checking an acceptance box or selecting an equivalent option constitutes express acceptance where the mechanism and applicable law permit it. Merely visiting the website is not presented as signing all contractual obligations.
Users must have legal capacity to contract; a parent, guardian or authorized representative must participate where required. Anyone acting for a business must have authority to bind it. No software licence is granted to a person who rejects terms that must be accepted to use it.
Kawaii Pizza™ may retain proportionate, necessary evidence of agreement, including its version, date, language, transaction and acceptance action, with applicable safeguards and lawful retention periods. A browser language preference does not, by itself, prove contractual acceptance.
Selecting a display language does not, by itself, constitute acceptance. The French version is accessible before acceptance. The cart requests renewed acceptance when the language, items, quantities, fulfilment method or collection/delivery location changes. Evidence collected remains subject to privacy requirements; accepting these Terms is not general consent to advertising or processing unrelated to the contract.
Food orders, pickup and metro delivery
Orders depend on the products, hours and service areas actually offered. Before a contract is concluded, the offer states the supplier, items and quantities, fulfilment method and location, stated timeframe, restrictions, currency and total amount, including applicable taxes, charges and deposits. The customer can review and correct the selection or decline before confirming.
For metro delivery or local pickup, the meeting point and essential conditions must be known before commitment. Practical instructions may supplement the confirmation without changing the agreed terms. Access from another country does not mean delivery is offered there.
Rules depend on the product and applicable law. In Quebec, sales of goods liable to deteriorate rapidly are excepted from the specific distance-contract rules; other applicable obligations remain. This exception does not automatically extend to non-perishable drinks, merchandise, software or every mixed order.
Where a transaction is subject to Quebec’s distance-contract transmission rules, a retainable copy is provided within the applicable statutory period, normally no later than 15 days after conclusion. The confirmation records the offer’s terms and information needed to perform the contract.
Payments, cancellations and refunds
Payment is processed through the authorized provider identified during ordering. The customer must be authorized to use the chosen payment method. This interface does not request payment while the payment service is unavailable.
Amendment, cancellation and refund conditions specific to prepared food, non-perishable goods and digital content are presented with the offer before the contract is concluded. These Terms do not permit an undisclosed restriction to be added after ordering. Requests may be sent to info@kawaiipizza.ca with the order reference and a description of the issue, without complete card numbers.
A cancellation request is not confirmation of cancellation; it is handled under the agreed terms and applicable rights. Mandatory remedies for defects, non-delivery or other breaches remain available. These Terms do not grant a general right to withhold statutory refunds or cancel accepted orders simply because of a pricing error.
Fraudulent chargebacks, deliberate payment abuse or knowingly false information may result in proportionate measures and available lawful remedies. A good-faith dispute or exercise of a legal right is not, by itself, abuse.
Food safety and allergens
Ingredients, allergens and cross-contact risks must be checked for the specific product. General website information does not guarantee the absence of an allergen. Before ordering, ask the outlet for the information you need and disclose any allergy or restriction so that it can confirm whether the request can be accommodated.
Any special allergy request must be addressed directly to the outlet and confirmed before preparation. No clause replaces accurate food information or excludes responsibilities that the law does not permit to be excluded.
Application, software and video-game licence
Once access conditions are met, a limited, personal, non-exclusive, non-sublicensable and non-transferable licence, subject to mandatory rights, is granted to use an authorized copy for personal, non-commercial purposes on compatible devices. Valid authorized-platform terms and product-specific notices also apply.
Buying, downloading or installing an app, APK, game or content does not transfer ownership of its code, characters, music, interfaces, designs or other assets. No implied licence is granted to manufacture products, establish a franchise, redistribute the game or commercially exploit its resources.
If virtual coins, items or features are offered, their terms and prices will be disclosed before purchase; unless expressly offered otherwise, they are not money, confer no rights in the business and cannot be resold or redeemed for cash. Third-party or open-source licences prevail for their respective components.
Prohibited uses and system protection
Unless authorized in writing or permitted by a statutory right that cannot be excluded, the following are prohibited:
- Copying, reselling, redistributing or publishing protected apps, APKs, installers or resources; removing attribution or ownership notices.
- Modifying, decompiling or reverse engineering software; bypassing licences, payments, access controls or technical measures, subject to applicable statutory exceptions.
- Using cheats, bots, exploits, malware, others’ credentials or unauthorized access; disrupting services, falsifying purchases or abusively automating requests.
- Impersonating the brand, its representatives or official channels; offering counterfeit products or using its assets to imply sponsorship or authorization.
- Mass extraction of protected resources or use of those resources to train AI systems without authorization, to the extent that restriction is legally enforceable.
Users are responsible for demonstrable harm caused by their unlawful conduct. Rooting or jailbreaking alone is not treated as infringement; the actual conduct and its connection to harm will be considered. Mandatory statutory exceptions, lawful criticism and third-party rights remain unaffected.
Ordinary software risks and updates
Software and video games may be affected by temporary bugs, operating-system changes, network outages, updates, incompatibilities or loss of local data caused by circumstances outside Kawaii Pizza™’s reasonable control. Users should maintain compatible devices, sufficient storage and reasonable account security.
Updates may correct defects, improve compatibility, add or remove features or address security risks. Material contractual changes will be handled in accordance with applicable notice, consent and termination requirements.
Liability and permitted limitations
Kawaii Pizza™ does not guarantee compatibility with every third-party device or network or indefinite availability of a free service. This does not change expressly contracted features, statutory warranties or obligations that cannot be excluded.
For business users not acting as consumers, and only to the extent permitted by law: liability is excluded for lost profits and indirect or consequential losses arising from third-party outages, unauthorized uses or circumstances outside Kawaii Pizza™’s reasonable control. This clause does not impose a general release of liability against consumers.
No limitation covers fraud, intentional misconduct, gross fault, bodily or moral injury, food-safety breaches or other liabilities where exclusion is prohibited by law. Third parties’ responsibilities are determined by their own conduct and applicable law.
Third-party claims and indemnification
In business relationships and to the extent legally permitted, users will indemnify Kawaii Pizza™ and affected rights holders for substantiated damages, third-party claims and reasonable defence costs caused by their fraud, infringement, unlawful distribution, cyberattacks or culpable material breach. Reasonable notice and an opportunity to participate in the defence will be provided; a settlement acknowledging obligations on behalf of Kawaii Pizza™ cannot be imposed without written authorization.
This contractual obligation is not imposed on consumers and does not transfer losses attributable to Kawaii Pizza™. Statutory remedies and compensation remain available against any infringer, without automatic fines or punitive amounts set by these Terms.
Trademarks, logos, designs, works, patents and secrets
11.1 · Ownership and reservation of rights
All applicable rights are reserved in Kawaii Pizza™, its cat-pizza logo, names and distinctive signs, slogans, packaging and trade dress; characters, illustrations, photographs, animations, posters, texts, musical compositions, jingles, recordings and videos; source and object code, applications, games, interfaces, levels and digital resources; and other protectable creations, inventions and confidential know-how. Each reservation operates within rights that actually exist and licences from their owners. Third-party materials retain their own ownership.
11.2 · Trademarks and trade dress
No authorization is given to use Kawaii Pizza™ signs on products, packaging, stores, advertising, domains, social accounts, applications or metadata that cause confusion about origin, affiliation, sponsorship or authorization. Distinctive signs are protected to the extent provided by applicable law.
11.3 · Works, designs and commercial uses
Subject to third-party rights, personal viewing of the website and technical copies necessary for its normal display are permitted. This permission transfers no ownership and does not authorize redistribution of resources, manufacture of merchandise or commercial use of the brand or creations. Other uses require authorization from the relevant rights holder unless permitted by applicable law.
Beyond the viewing permission above, without written authorization or an applicable statutory exception, protected materials may not be reproduced, adapted, translated, distributed, communicated to the public, sold, licensed or exploited, including merchandising, print-on-demand and commercial reuse of game resources. Public access, buying a pizza or downloading an app grants no such rights. Any authorization is limited to its purpose, media, territory, duration and conditions; further uses require an additional agreement.
11.4 · Patents and industrial designs
Rights in inventions, patents, applications and industrial designs that exist or are lawfully obtained are reserved with their applicable scope and territories. Merely accessing the website does not license exploitation of a patented invention. Any authorization must come from the rights holder with authority to grant it and expressly cover the relevant acts and territories.
11.5 · Confidential information
Unlawful acquisition, use or disclosure of non-public code, secret recipes or processes, credentials, prototypes, business documents or protected franchise information is not authorized. Specific confidentiality duties are established through appropriate agreements and applicable law. This clause does not turn public information into a secret; legally required disclosures and valid exceptions remain available.
International scope: Kawaii Pizza™ and the relevant rights holders may assert their rights and licences in Canada and other territories where recognized. Protection and enforcement depend on the type of right, registrations where required, applicable treaties and the law of the relevant country.
Privacy, local storage and data
This version stores the cart and selected language in the browser. However, the home page opens in French on each load, even if another language was previously selected. Session storage prevents another automatic music playback during the same visit. When a configured payment is initiated, it may temporarily store the pending order and associated acceptance information: version, language, date and reference.
Local data remain until cleared or removed by the browser. Session data normally last for the tab’s session. Clearing them resets the corresponding features. This version includes no behavioural advertising, third-party analytics or card form. Hosting and external services may process technical logs; information about activated services must be provided before the relevant collection.
Information sent by email, during an available transaction or in an incident report is used as necessary to respond, fulfil the order, prevent fraud, comply with law or defend claims. Acceptance evidence documents the contract and does not authorize unrelated uses. Do not send complete card numbers or unnecessary sensitive information.
Collection and access are limited to justified needs. Retention depends on data categories, purposes and applicable obligations; information no longer needed is deleted or anonymized as required by law. Providers, processing locations and retention arrangements specific to a feature are set out in its notice. No guarantee is made that storage occurs exclusively in Canada.
Where Quebec law requires it, a transfer or outsourced processing outside Quebec is subject to the required assessment and appropriate written agreement before implementation. Other applicable provincial, federal or foreign obligations remain. A link to a third-party service does not authorize unlimited disclosure of information to it.
For questions, complaints, access, correction or withdrawal of consent, contact info@kawaiipizza.ca with “Privacy” in the subject. Requests are routed to the responsible person and only necessary identity checks are requested. Responses follow statutory time limits and you may contact the competent regulator. Withdrawal does not erase earlier lawful processing or legally required retention.
Accepting the Terms is not general consent to marketing, profiling or collecting children’s data. An application or feature collecting additional information must provide its own notice and obtain required consents before collection.
Applicable law and international disputes
Use of the services and protection of assets are not limited to Quebec. As a contractual framework, Quebec law and the federal laws of Canada applicable there govern, without displacing mandatory rules of another province, territory or country that must apply. The existence, scope and infringement of intellectual-property rights are assessed under the relevant laws of the territory where protection is sought.
For business relationships, not consumer relationships: unless a written agreement provides otherwise and where valid, competent courts in the district of Montréal will have jurisdiction over contractual disputes. Rights holders retain the ability to seek urgent relief or intellectual-property protection before other competent courts, including those where infringement occurs.
Consumers retain the courts, warranties and non-waivable remedies provided by applicable law, within or outside Canada. No mandatory advance arbitration or class-action waiver is imposed. Direct communication and mediation are voluntary and do not, by themselves, suspend or shorten a statutory deadline.
Suspension, termination and surviving rights
Kawaii Pizza™ may restrict compromised access, block unauthorized distributions, remove unlawful content or suspend services for a material breach, fraud, security risk or legal requirement, proportionately and consistently with existing obligations. Notice and an opportunity to cure will be provided where legally required or reasonable; urgent risks may require immediate action.
Valid termination of a licence requires ending the use it authorized and deleting unauthorized copies, except for legally required retention. It does not remove mandatory refunds or performance obligations or authorize indiscriminate remote deletion of device data.
Ownership, reservations of rights, valid confidentiality obligations, accrued obligations and remedies for earlier infringements survive as applicable. Failure to claim immediately is not authorization or waiver.
Franchises, partners and commercial authorizations
The website, its advertisements and requests for information grant no franchise, exclusivity, distribution, agency or commercial licence in Kawaii Pizza™. These rights require a written agreement with the rights holder or authorized representative defining territory, duration, products, quality control and permitted uses.
Distributors, manufacturers, developers, designers and other contributors must separately agree ownership of contributions, necessary assignments or licences, confidentiality and, where relevant and valid, treatment of moral rights. These public Terms do not replace those agreements or automatically transfer contributors’ rights.
Do not submit trade secrets or confidential proposals without a prior agreement. Sending an inquiry or suggestion does not automatically transfer ownership or require Kawaii Pizza™ to enter into a contract, pay or grant exclusivity. Third parties are not authorized to promise brand rights on its behalf.
Reporting and enforcing intellectual-property rights
Report suspected unauthorized uses to info@kawaiipizza.ca, with “Intellectual property” in the subject, identifying the asset, its owner or your authority, links, dates and reasonable evidence. Provide accurate information and avoid unnecessary personal data. Receipt of a notice does not automatically establish infringement.
Depending on evidence and applicable law, a rights holder with standing may seek cessation, content or listing removal, action by platforms or customs authorities, urgent court orders, damages, an account of profits or other available remedies. No outcome, penalty or compensation is automatic merely because this policy is published.
Evidence will be preserved lawfully and proportionately. Measures against copying do not prevent uses permitted by a licence, statutory exception or competent decision.
Languages, changes and contact
The terms are offered in French, Spanish and English. The French version is accessible before acceptance. Where required by law, another contractual language is chosen only after the French-language requirements have been met and the adhering party has expressly chosen it. No language-priority rule limits mandatory rights.
Changes will be identified by date and version. New terms will govern future relationships through valid acceptance; changes to ongoing contracts will comply with notice, consent and termination requirements. They will not apply retroactively to remove accrued rights.
An invalid provision will be ineffective to the extent necessary, with other provisions remaining where they can operate independently. A specific written agreement prevails over these Terms for its subject matter, subject to mandatory law.
